THC Drinks in NYC After December 11: What Changes and Where to Buy

NY cannabis guide › THC drinks after December 11

On December 11, 2026 a federal law takes effect that treats any hemp product with more than 0.4 milligrams of total THC per container as illegal marijuana. That covers almost every hemp THC seltzer and soda now sold in NYC bodegas, delis, bars and liquor stores. Cannabis drinks sold in state-licensed dispensaries are not hemp and are not affected: they can still hold up to 10 mg of THC per serving. Unless Congress changes the law again before the deadline, the place to buy a THC drink in New York City after Dec 11 is a licensed dispensary.

If you have bought a can of THC seltzer at a corner store in Bushwick or a bar in the West Village, this deadline is about you. It is not about the drinks on dispensary shelves. Here is what changes, what stays legal, and where you can still buy a THC drink in the five boroughs. For the legal background in more depth, see our explainer Are hemp drinks legal in New York?

What changes on December 11

A federal spending law signed in November 2025 rewrote the definition of hemp. Any finished hemp-derived product with more than 0.4 mg of total THC per container, counting THCa, no longer counts as hemp. It was set to take effect on November 12, 2026. A short-term funding bill signed on September 2, 2026 moved the date for naturally derived cannabinoids to December 11, 2026; synthetic cannabinoids lost their hemp status on November 12 as planned.

After Dec 11, a hemp drink over the cap is treated like marijuana under federal law. That covers the 5 mg and 10 mg THC drinks that became common outside dispensaries, along with hemp gummies and many full-spectrum CBD products. New York’s Office of Cannabis Management says the federal change does not replace the state’s own hemp program, but that consumers should expect fewer products, especially from out of state; its federal hemp law FAQ sets out the state’s position.

How much THC each kind of drink can have

New York already had tight rules for hemp drinks: 1 mg of THC per serving, 10 mg per package, at least 15 times more CBD than THC, and every beverage container must be a single serving. Many drinks sold in bodegas and bars did not meet those rules even before the federal change. Licensed cannabis drinks follow the adult-use rules instead.

What happens at bodegas, delis and bars

Stores that sell hemp THC drinks above the federal cap after Dec 11 will be selling a federally illegal product, and stronger drinks were already outside New York’s hemp rules. In September 2026 a Hochul administration official called bodega and deli sales of THC drinks untenable and said the issue may be a priority for the 2027 legislative session. Bills that would have let liquor stores sell low-dose drinks did not pass. We found no State Liquor Authority rule on THC drinks in bars, so expect bars and restaurants to pull them from menus rather than risk their liquor license.

If you see a THC drink on a deli shelf after Dec 11, treat it like any other unlicensed cannabis product: untested and not legal to sell.

Where to buy a THC drink in NYC after December 11

Licensed dispensaries sell cannabis beverages made by New York licensed processors, tested and labeled under adult-use rules. They can hold up to 10 mg of THC per serving and 100 mg per package. Low-dose drinks exist too: the New York brand Ayrloom, for example, sells 1 mg “micro” drinks and says it is in more than 600 licensed dispensaries statewide. You must be 21 or older with ID, and you pay with cash or debit plus 13% tax.

Could the deadline change again?

Possibly. Several bills in Congress would regulate hemp drinks like alcohol or set a higher THC cap, and the hemp industry is lobbying for another delay. Law firm Foley Hoag reported in September 2026 that a White House official had committed to no further extensions. Unless a new law passes before Dec 11, the cap takes effect. We will update this page if that changes.
