Is delta-8 THC legal to buy in New York? No. State hemp rules have barred its sale to consumers since 2021, although enforcement took years to reach the products already sitting on convenience store shelves.

What Is Delta-8 THC?

Delta-8 THC is a minor cannabinoid found in trace amounts in the cannabis plant. Unlike delta-9 THC, the compound most people mean when they say “THC,” delta-8 is usually manufactured by chemically converting CBD extracted from hemp. Delta-8’s Legal Status in New York

  • Delta-8 THC products are not permitted for retail sale to consumers under New York’s cannabinoid hemp rules.
  • The state’s hemp regulation rules go further than a cap. 9 NYCRR 114.8 bars hemp products from containing cannabinoids created through isomerization, and it names delta-8 and delta-10. Separate limits of 1 mg of total THC per serving and 10 mg per package apply to anything eaten or drunk.
  • Intoxicating cannabinoids, including delta-8, are instead meant to move through New York’s licensed adult-use cannabis system, the same one that supplies the licensed dispensaries on our NYC list.
  • Enforcement has been uneven. Smoke shops and gas stations in New York City and upstate have sold delta-8 products for years despite the rule, and the state has leaned on the Office of Cannabis Management (OCM) to crack down store by store.

He said that when the Cannabinoid Hemp Program regulations were approved, and it still describes the situation. New York has a framework for hemp-derived cannabinoids. It was written to keep intoxicating products out of ordinary retail and leave them to the licensed adult-use market.

How New York Is Regulating the Cannabinoid Hemp Market

  1. Testing and labeling requirements. Hemp products sold in New York must be tested by a licensed lab and labeled with cannabinoid content.
  2. THC caps and the isomerization ban. Hemp products are capped on total and per-serving THC, and converted cannabinoids are barred outright. Between them the two rules exclude delta-8 edibles and vapes.
  3. Licensing for processors and retailers. Anyone manufacturing or selling cannabinoid hemp products needs a state license, separate from an adult-use cannabis license.
  4. Ongoing enforcement. OCM has the authority to fine, seize product from, and shut down unlicensed retailers selling intoxicating hemp products, delta-8 included.

The FDA has weighed in too. Its guidance on cannabis-derived products flags delta-8 as a concern, particularly when it is sold in packaging that appeals to children or with unproven health claims.
